Terms of service

1. About us
This website, gospelgrowers.com, is operated by Barker Graftworks Ltd, trading as Gospel Growers (“Gospel Growers”, “we”, “us” or “our”).
Barker Graftworks Ltd is registered in England and Wales under company number 17302667.
Registered office: 4 Dean Road, Woodthorpe, Nottingham, NG5 4FJ

2. These terms
These Terms of Service apply when you use our website or purchase products from us. By placing an order, you confirm that you accept these terms.
Our Privacy Policy, Shipping Policy and Refund Policy also apply. Please read them before placing an order.
Nothing in these terms limits any legal rights you have as a consumer.
You must be at least 18 years old to place an order, or have permission from a parent or legal guardian.
3. Our products
We sell Christian books, activity books, bundles and related products. The format, edition, dimensions and other important characteristics of each product will be described on its product page.
We take reasonable care to ensure that product descriptions, prices and images are accurate. Colours and appearance may vary slightly depending on your screen, and printed products may have minor differences between print runs.
Some of our books are printed after an order is placed and fulfilled by third-party printing and fulfilment partners, which may include BookVault. This does not affect your rights against us as the retailer.
Products are subject to availability. We may place reasonable limits on the number of products that can be purchased in a single order.
4. Orders and formation of the contract
When you submit an order, you are offering to purchase the products in your basket.
An automated order acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it. Your order is accepted when we send confirmation that it has been accepted or dispatched.
We may decline an order before acceptance if:
-
The product is unavailable.
-
We cannot authorise your payment.
-
We cannot deliver to the address or country provided.
-
The price or product information contained an obvious error.
-
We reasonably suspect fraud, misuse or unlawful activity.
If payment has already been taken for an order we cannot accept, we will issue a full refund.
Please check your order and delivery details carefully. If you need to make a change, contact us as soon as possible at hello@gospelgrowers.com. We cannot guarantee that an order can be changed once printing or fulfilment has begun, although your statutory cancellation rights will not be affected.
5. Prices and payment
Prices will be displayed in the currency selected or made available through our store. The total price, including applicable taxes and delivery charges collected by us, will be shown before you complete checkout.
Payment must be made using one of the payment methods offered at checkout. Payments may be processed by Shopify Payments or another authorised payment provider.
For international orders, customs duties, import taxes or handling charges may be imposed by the destination country. Unless checkout states that these charges have been prepaid or included, you are responsible for paying them. We do not control these charges.
If we discover an obvious pricing error before accepting an order, we will contact you and give you the option to purchase at the correct price or cancel for a full refund.
6. Delivery
Delivery destinations, prices and estimated times are explained in our Shipping Policy and at checkout.
Because some products are printed to order, estimated delivery times may include both production and shipping time. Delivery estimates are not guaranteed dates unless we expressly agree otherwise.
For UK consumer orders, we will deliver without undue delay and ordinarily within 30 days of the contract being formed unless a different delivery period has been agreed with you.
We remain responsible for the products until they are delivered to you or to a person you have nominated to receive them. Ownership passes to you once we have received payment in full and the products have been delivered.
You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you discover an error. Additional delivery costs may apply if an order must be resent because an incorrect or incomplete address was supplied.
If an order is delayed, lost or returned to sender, contact hello@gospelgrowers.com so that we can investigate and provide an appropriate remedy.
7. Cancellations, returns and refunds
Our Refund Policy explains how to request a cancellation, return or refund and forms part of these terms.
If you are a UK consumer purchasing online, you will normally have the legal right to cancel your purchase of physical goods within 14 days after receiving them, without giving a reason. After telling us that you wish to cancel, you normally have a further 14 days to return the products.
Our Refund Policy may provide a longer voluntary returns period. Any additional return rights we offer are provided alongside, and do not replace, your statutory rights.
Unless we agree otherwise, you are responsible for the direct cost of returning an unwanted product. We will refund the original standard delivery charge where required by law, but not any additional amount paid for an enhanced or express delivery option.
We may reduce a change-of-mind refund if a product has been handled beyond what would reasonably be necessary to inspect its nature, characteristics and operation.
A standard book is not considered personalised merely because it was printed after you ordered it. Cancellation exceptions may apply to genuinely personalised or bespoke products where permitted by law.
Contact us before posting a return so that we can provide the correct returns address. Products must not be returned directly to BookVault or to our registered office unless we specifically instruct you to do so. Contacting us for the correct address does not restrict your statutory right to cancel.
8. Faulty, damaged or incorrect products
We are responsible for supplying products that are of satisfactory quality, fit for purpose and as described.
Please contact hello@gospelgrowers.com if a product arrives damaged, is defective, is materially different from its description, or if you receive the wrong item. Providing photographs of the product and packaging may help us resolve the issue more quickly, but a failure to provide photographs does not remove your legal rights.
Depending on the circumstances and applicable law, you may be entitled to a refund, replacement, repair or price reduction. UK consumers may have a short-term right to reject faulty goods within 30 days.
Damage caused by misuse, accidental damage after delivery or normal wear and tear is not treated as a product fault.
9. Bundles and promotions
Bundles, discounts and promotional offers may be subject to additional conditions displayed with the offer.
If you return an entire bundle under a change-of-mind return, all products included in that bundle must normally be returned. If we agree to accept a voluntary return of only part of a bundle, we may recalculate the refund to reflect the price of the products retained and the removal of any bundle discount.
This does not limit your rights where an individual product within a bundle is faulty, damaged or incorrectly supplied.
Promotional codes have no cash value and cannot be combined unless we expressly state otherwise.
10. Intellectual property
The website and its content—including our books, illustrations, artwork, branding, logos, written material, music, audio and website design—are owned by or licensed to Barker Graftworks Ltd and are protected by intellectual-property laws.
We grant you a limited, personal and non-commercial right to access and use the website and any freely available music or resources for their intended purpose.
You must not copy, reproduce, distribute, sell, modify, publish, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.
Purchasing a product does not transfer ownership of the intellectual-property rights in its content.
11. Acceptable use
You must not:
-
Use the website for unlawful, fraudulent or harmful purposes.
-
Attempt to gain unauthorised access to the website or its systems.
-
Introduce viruses, malicious code or other harmful technology.
-
Scrape, harvest or systematically extract website content or customer data.
-
Interfere with the website’s security, operation or availability.
-
Infringe our rights or the rights of another person.
We may restrict access where reasonably necessary to protect the website, our customers or our legal rights.
12. Reviews and submitted content
If you submit a review, testimonial, photograph or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with our business and marketing. You retain ownership of your content.
We may remove submitted content that is unlawful, abusive, misleading, irrelevant or otherwise inappropriate.
13. Third-party services and links
Our store is hosted using Shopify, and we may use third parties for payment processing, printing, fulfilment, delivery, analytics and other services.
Where a third party acts on our behalf to fulfil your order, your sales contract remains with Barker Graftworks Ltd. We do not exclude responsibility for our obligations merely because we use a subcontractor or fulfilment provider.
Our website may contain links to websites operated by other organisations. We are not responsible for their independent content, availability or privacy practices. You should review their terms before using them.
14. Privacy
We process personal information as explained in our Privacy Policy. By using our website, you acknowledge that your information may be processed by service providers involved in operating the store and fulfilling your order, subject to applicable data-protection law.
15. Website availability
We try to keep the website accurate, secure and available, but we cannot guarantee uninterrupted access. We may temporarily suspend access for maintenance, security or operational reasons.
We may change or withdraw free website features and content. This will not affect orders we have already accepted or any rights you have in relation to them.
16. Our responsibility to consumers
We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses caused by information or instructions supplied incorrectly by you.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Faulty or misdescribed products.
-
Any other liability that cannot legally be excluded.
-
Your statutory consumer rights.
If you purchase a product wholly or mainly for business purposes, these terms are primarily intended for consumers. Please contact us before placing a wholesale or business order so that appropriate business terms can be agreed.
17. Events outside our reasonable control
We are not responsible for delay caused by an event outside our reasonable control, such as severe weather, transport disruption, industrial action, natural disaster or widespread network failure.
If this happens, we will contact affected customers where reasonably possible and take reasonable steps to minimise the delay. Your legal rights regarding significantly delayed or undelivered orders remain unaffected.
18. Complaints
If you have a complaint, contact us at hello@gospelgrowers.com with your order number and an explanation of the issue.
We will try to acknowledge your complaint promptly and resolve it fairly within a reasonable period.
19. Changes to these terms
We may update these terms to reflect changes to our business, website or legal obligations.
The terms applying to an order are those in effect when that order is placed. We will not retrospectively change the terms of an accepted order without your agreement.
20. Severability and waiver
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
If we delay enforcing a right, this does not mean that we have waived that right.
21. Governing law
These terms and any contract between you and us are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, you will also retain any mandatory protections provided by the laws of your country or region. Nothing in these terms prevents you from bringing proceedings in a court available to you under applicable consumer law.
